IHREC is now seeking to appoint at least 9 new members to its Disability Advisory Committee and is inviting expressions of interest for appointment to the Committee.

In March 2018, Ireland ratified the UN Convention on the Rights of Persons with Disabilities (CRPD). The Irish Human Rights and Equality Commission (IHREC), as Ireland’s National Human Rights and Equality Institution, is the independent monitoring mechanism.

IHREC’s Disability Advisory Committee was established in 2018 to assist and advise the Commission on the adequacy and effectiveness of law and practice in Ireland relating to the protection of people with disabilities; and to advise the Commission on the fulfilment of its CRPD independent monitoring role.

The Committee includes members of the Commission and external members appointed by the Commission. These new appointments will bring the external membership of the Committee to thirteen. At least 75% of the (that is 10 members) of the external members of the Disability Advisory Committee will be disabled people.

The Commission’s definition of disability in this regard is aligned to CRPD Article 1, which states:
“Persons with disabilities include those who have long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others.”

The Commission aims to ensure that the membership of the Advisory Committee will, as far as possible, represent the diversity of Irish society, including the diversity of disabled people and that there will be equality of representation of women and men.

The Commission also aims to ensure that the membership of the Advisory Committee includes expertise in the following areas:

  • Participation of persons with disabilities within society, such as in economic, social, cultural or political life.
  • The Irish legal and policy landscape, and its relevance for disabled people.
  • Communication and advocacy to promote participation of disabled people in society.
  • Collection and use of data to support the monitoring of the UN Convention on the Rights of Persons with Disabilities in Ireland.
  • Knowledge of the Convention on the Rights of Persons with Disabilities and the United Nations system pertaining to the Convention.
  • Intersectionality across the grounds in the Equality Acts (gender, marital status, family status, age, disability, sexual orientation, race, religion, and membership of the Traveller community), and the experience of poverty.
  • Representation of under-represented voices/perspectives in the disability rights landscape.

Bí páirteach san iarracht chun cearta daonna agus comhionannas daoine faoi mhíchumas in Éirinn a chur chun cinn

Tá IHREC ag iarraidh ar a laghad 9 chomhalta nua le ceapadh ar a Choiste Comhairleach Míchumais faoi láthair, agus tá sé ag lorg léirithe spéise i dtaca lena gceapachán ar an gCoiste.

I mí an Mhárta 2018, rinne Éire Coinbhinsiún na Náisiún Aontaithe um Chearta Dhaoine Faoi Mhíchumas (CRPD) a dhaingniú. Is é Coimisiún na hÉireann um Chearta an Duine agus Comhionannas (IHREC), mar Institiúid Náisiúnta na hÉireann um Chearta an Duine agus Comhionannas, an sásra monatóireachta neamhspleách.

Bunaíodh Coiste Comhairleach an IHREC um Míchumas in 2019 chun cúnamh agus comhairle a thabhairt don Choimisiún maidir le leordhóthanacht agus éifeachtacht an dlí agus an chleachtais in Éirinn chun daoine faoi mhíchumas a chosaint; agus comhairle a thabhairt don Choimisiún maidir le comhlíonadh a róil faireacháin CRPD neamhspleách.

Ar an gCoiste tá comhaltaí de chuid an Choimisiúin agus comhaltaí seachtracha arna gceapadh ag an gCoimisiún. Leis na ceapacháin nua seo méadófar líon na gcomhaltaí seachtracha ar an gCoiste go dtí trí duine dhéag. Cuimseofar le daoine faoi mhíchumas 75% ar a laghad (is é sin le rá 10 gcomhalta) de chomhaltaí seachtracha an Choiste Chomhairligh um Míchumas.

Tá an sainmhíniú ar an míchumas atá ag an gCoimisiún sa chomhthéacs seo ailínithe le Airteagal 1 den CRPD, ina bhfuil sé luaite:
“Cuimsítear le daoine faoi mhíchumas iad siúd a bhfuil laigí fadtéarmacha coirp, meabhracha, intleachtúla nó céadfacha acu a d’fhéadfadh bac a chur ar a rannpháirtíocht iomlán agus éifeachtach sa tsochaí ar bhonn comhionann le daoine eile mar gheall ar bhacainní éagsúla a bheith le tabhairt acu.”

Tá sé mar aidhm ag an gCoimisiún a chinntiú go léireofar le comhaltaí an Choiste Chomhairligh, an oiread is gur féidir, éagsúlacht shochaí na hÉireann, lena n-áirítear éagsúlacht na ndaoine faoi mhíchumas agus go mbeidh comhionannais ionadaíochta idir mhná agus fhir ann.

Tá sé mar aidhm ag an gCoimisiún chomh maith a chinntiú go mbeidh ag daoine de chuid comhaltaí an Choiste Chomhairligh saineolas sna réimsí seo a leanas:

  1. Rannpháirteachas daoine faoi mhíchumas sa tsochaí, ar nós sa saol geilleagrach, sóisialta, cultúrtha nó polaitiúil.
  2. Tírdhreach dlí agus beartais na hÉireann, agus a ábharthacht do dhaoine faoi mhíchumas.
  3. Cumarsáid agus abhcóideacht chun rannpháirteachas daoine faoi mhíchumas sa tsochaí a chur chun cinn.
  4. Bailiú agus úsáid sonraí chun tacú le monatóireacht ar Choinbhinsiún na Náisiún Aontaithe ar Chearta Daoine faoi Mhíchumas in Éirinn.
  5. Eolas ar an gCoinbhinsiún ar Chearta Daoine atá faoi Mhíchumas agus ar chóras na Náisiún Aontaithe a bhaineann leis an gCoinbhinsiún.
  6. Trasnachas sna forais sna hAchtanna Comhionannais (inscne, stádas sibhialta, stádas teaghlaigh, aois, míchumas, gnéaschlaonadh, cine, reiligiún agus comhaltas den Lucht Siúil), agus eispéireas na bochtaineachta.
  7. Ionadaíocht ar ghuthanna/dearcthaí faoi ghannionadaíocht i dtírdhreach chearta na ndaoine faoi mhíchumas.
